LLC Formation

Nearly a Century of Combined Legal Experience

Some of the main concerns of a business owner is whether or not their own private finances could be affected by problems within the company, or without. If a member of the general public decides to bring a lawsuit against your business, you, as the controller of it, might be personally held accountable for any damages or compensation amounts paid out. To avoid this awkward and frustration consequence, you should consider that forming a limited liability company (LLC) might be the right choice for you.

At Buckley Bala Wilson Mew LLP, our Atlanta business litigation attorneys take pride in being able to take business owners and their businesses to new and exciting stages without getting them tied up in confusing litigation and regulations. With both of our founding attorneys being AV® Preeminent™ Rated by Martindale-Hubbell®, people all across Georgia have come to recognize our skill and our dedication to our clients. If forming an LLC is the next step for you, we genuinely want to be the business lawyers who get you there.

If LLC formation is not the right option, determined after an initial case evaluation, we can try to point you in the right direction.

LLC Basics and Guidelines

What in business law and corporate dealings does not seem like a complicated mess at first glance? LLC formation really is not that different in the way that those who have not familiarized themselves with the procedure can find it daunting or, at the least, time-consuming. When you let us handle matters for you, everything will be so much clearer.

For the most part, you will be concerned with five phases of LLC formation:

  1. Choosing a name: The name of your business is often the face of your business. We can help you find a name that is not taken already in the registry and that fits the goal you had in mind.
  2. Filing the paperwork: Documentation for LLC formation can quickly pile up; details can get mixed up and overlooked, which could spell disaster for the whole process. Let us handle all the contracts and paperwork so nothing is missing or mistakenly created.
  3. Making operations: Within your LLC formation, you will want to set guidelines for how the business will be operated – this is called an operating agreement.
  4. Letting others know: Depending on your business, and sometimes your county, you may have to publically publish the announcement of your LLC’s formation. If you do, you may as well take this time to spin it towards advertising!
  5. Obtaining the license: All of this will be for naught if you do not actually obtain your license once it is approved. The circumstances of your business may require you to publically display this license, such as sticking a food service related license in the storefront window.
